TPO Pastuszak Coach & Vehicle Hire Terms & Conditions
By placing a booking with TPO Pastuszak/GPN Poland, the Customer acknowledges that they have read, understood and agree to accept the Terms and Conditions as detailed below.
- The Company: TPO Pastuszak sp. z oo, sp. K with office at Biskupinska 28, 30-732 Krakow
- The Customer/ The Hirer: private person and/or organization making the booking
- The Driver: The Driver or Drivers of the vehicle, hired by the coach Company/Subcontractor
These terms & conditions apply whether the agreement is in written or verbal form. The Hirer acts on behalf of all the passengers travelling. If the Hirer is a company, group etc and individual must be named as a responsible person.
The Hirer is responsible for all actions and decisions of passengers on board including any additional costs incurred, whether or not they travel with the party.
The company can only accept instructions from the Hirer. If the Hirer is not travelling a representative must be chosen and the company informed prior to hire.
Normally, written confirmation by the Company is the only basis of acceptance of a hiring or subsequent alterations.
All quotations are given on the basis of information provided by the Hirer and are valid for 7 days, unless otherwise stated.
The route used is at the discretion of the Company, unless particularly specified by the Hirer, in which case it will be clearly shown on the confirmation.
Additional Charges and Surcharges
All bookings at the point of quotation will be based on the use of a single Driver however, for longer journeys in terms of hours the Company reserves the right to review the quotation should a second Driver be required, and should there be a need for additional charges, the Hirer will be advised at least (where possible) 7 days prior to the journey date.
If it is necessary to accommodate the Driver, these costs will be borne by the Hirer. Accommodation must be a single occupancy room of a reasonable basic standard and should include evening meal and breakfast as appropriate.
Any amendments to the original booking maybe charged directly by the Driver or by the Company at the end of the contract.
If, as a result of the Hirer or passengers, the coach requires cleaning over and above that normally carried out, the Hirer will be charged additional cost of 500pln.
The Company reserves the right to charge for damage to vehicles made by the Hirer and/or the passengers. Monies will be collected from the Hirer.
On collecting passengers from airports, the coach/vehicle will wait for one hour after the prearranged collection time free of charge. After that additional waiting time will be subject to charged, for coach 100PLN, for other vehicles 50PLN for each extra hour plus 8%tax.
Payment must be paid in full 14 days before the start of the hire unless otherwise agreed by the Company.
Cancellation by the Company
In the event of circumstances beyond the Company’s control e.g. civil unrest, strikes, police road closures, terrorist attacks etc (including adverse weather and road conditions) or in the event of the Hirer taking any action varying agreed conditions unilaterally the Company may, by returning all money paid and without further liability cancel the contract.
Cancellation by the Hirer
All cancellations must be made in writing and sending to email@example.com or firstname.lastname@example.org If the Hirer cancels, the following scale of charges will apply:Cancellation more than 14 days before the hire date – no chargeCancellation between 14 days and 12 days before the hire date – 50% of the hire chargeCancellation within 48 hours before the hire date – full charge, no refund will be given
Use of Vehicle
The Hirer cannot assume the use of the vehicle between the outward and return journey, or remain at destination for longer time than previously agreed with the Company.The Company must be notified of any bookings for football matches, music festivals or political demonstrations and rallies at the time of booking, as there may be specific legal or other requirements that could affect the booking.Failure to notify the Company correctly of the nature of the journey will be construed as breach of contract and at the Company’s absolute discretion may lead to termination of the booking without compensation or refund
Pictures of Vehicles
On request the Company can provide a photograph of the type of vehicle being supplied. The photograph supplied is illustrative only and may be a different make/model with different livery and appearance to that actually supplied for the booking, unless otherwise agreed.
Substitutions / Change of Vehicle/ Seating Capacity
The Company reserves the right to provide a larger vehicle than specified at no additional charge.
Neither the Hirer nor the Driver must load any vehicle beyond the number of passengers which it is legally permitted to carry.
The Company reserves the right to subcontract to another Operator to perform the hire or to supply replacement vehicles with the same number of seats.
Drivers hours and rest periods
The driver’s hours or driving and rest periods are strictly controlled and the current regulations must be complied with (EU 561/2006). The Company will agree the hours of operation of the hire and these MUST be observed.
Neither the Hirer nor any passenger shall delay or otherwise interrupt the journey in such a way that the driver is at risk of breaching regulations relating to driving hours and duty time. If any breach is likely to occur, the Hirer will be responsible for any additional costs incurred unless it is outside the control of the Hirer.
Delays and/or Breakdown
The Company gives any advice on journey time in good faith but does not guarantee the completion of any journey in any specific time and will not be liable for loss, delay or inconvenience caused by the actual time of the journey
Under the circumstances of traffic or road accidents, adverse weather conditions, compliance with police, customs or other government officials delaying the Driver picking up the client at the agreed time, the Company will not be liable for loss, delay or inconvenience caused
In the event of the failure of the company to provide the booked service any refund will be limited to the amount paid for the hire.
Coaches are not adapted for animal transport and it is not permitted to transport animals, unless agreed (in writing) by the Company.
Conduct of Passengers
The Driver is responsible for the safety of the passengers and vehicle.
Smoking and the consumption of alcohol and/or illegal drugs is not permitted on the coach and the Hirer will be responsible for ensuring that this is observed. Any passenger whose conduct is in breach of statutory regulations may be removed from a vehicle or prevented from boarding on the Driver’s authority
For any reason, the Driver has the discretion to either remove, or not allow any passengers on the coach if the passenger is abusive, damages the coach, or not fit to travel due to being intoxicated with alcohol or illegal drugs.
In such event, at the Driver’s sole discretion, the journey may continue once the passenger or passengers have been removed from the vehicle, but should passenger conduct result in summary termination of the journey, the Company reserves the right to cancel any other parts of a booking, and in such circumstances the forfeiture of any monies paid, and no claims for compensation or refund in either whole or part shall be entertained.
Any damage caused to the vehicle by the Hirer or any of the passengers shall be the responsibility of the Hirer and the Hirer shall be liable for all costs related thereto.
Insurance/Liability for Injury
All Passengers are covered by personal accident insurance of the Company/Subcontractor (NNW). The insurance covers only situation that may occur while the Passengers remains in the coach/vehicle. Any other incidents resulting in damages to the Passengers outside the coach/vehicle are not covered by this insurance. It is the responsibility of the Hirer to ensure that all Customers wear seat belts.
The Company will not accept any liability for damage, injury or loss for any passenger standing up or walking around the vehicle whilst in motion, or passengers being influenced by alcohol or drugs.
Luggage and Passengers Property
The vehicle supplied by the Company will take the number of passengers with their luggage including 1 piece of hand luggage weighing up to 10kg and 1 piece of primary luggage not exceeding 20kg per person, specified at the booking confirmation.
The Customer must ensure they specify the correct information at the time of the booking and inform the Company as soon as possible if there are any changes.
Whilst The Company will take all reasonable care with passenger’s property it cannot accept liability for any damage to, or loss of that property being carried on the vehicle and the Company strongly recommends that no valuables should be left on the vehicle at any time, even if that vehicle is locked.
The Company cannot accept responsibility for any loss of or damage to property left on the vehicle after hire.
Property found on the vehicle after hire will be held at the vehicle operating base for a maximum period of 30 days and disposed of thereafter. It is the Hirers’ or the passenger’s responsibility to collect the property and any costs incurred to collect the property are to be borne by the Hirer or passenger.
In the event of a complaint the Hirer should seek a solution at the time from the driver or company. If a remedy has not been provided, complaints should be submitted in writing to the Company within 14 days of terminations time of hire.
Complaints will be dealt with, in accordance with the Company complaints procedure, within 14 days of receipt of the written complaint sent to email@example.com or firstname.lastname@example.org
